Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the StrokesIQ iOS application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and StrokesIQ ("we", "our", or "us"). We reserve the right to update these Terms at any time. Your continued use of the App following any changes constitutes acceptance of those changes.

2. Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this requirement. If you are using the App on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

3. Account Registration

To access the App's features, you must create an account. You may sign in using your email address, Apple ID, or Google account. You are responsible for:

  • Maintaining the confidentiality of your account credentials.
  • All activity that occurs under your account.
  • Providing accurate and current information.
  • Notifying us immediately at hello@kacper-turek.com if you suspect unauthorised access to your account.

4. Subscriptions and Billing

Free tier. The App is available for free with limited functionality, including up to 5 rounds per calendar month.

Pro subscription. A Pro subscription unlocks unlimited rounds, trend charts, weakest area analysis, personalised practice drills, course library access, and CSV export. Pro is available as a monthly ($3.99/month) or annual ($29.99/year) subscription.

Billing. All subscriptions are processed through the Apple App Store. By subscribing, you agree to Apple's payment terms. Your subscription will automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date.

Free trials. We may offer free trial periods for the Pro subscription. If you do not cancel before the trial ends, your payment method will be charged at the standard subscription rate.

Refunds. All purchases are subject to Apple's refund policy. We do not control and cannot override Apple's refund decisions.

Cancellation. You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for unused portions of a subscription period.

5. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You must not:

  • Use the App in any way that violates applicable local, national, or international law.
  • Attempt to gain unauthorised access to any part of the App or its infrastructure.
  • Reverse engineer, decompile, or disassemble any part of the App.
  • Use automated means to access or interact with the App.
  • Transmit any material that is harmful, offensive, or infringes the rights of others.
  • Share your account credentials or allow others to access the App through your account.

6. Intellectual Property

The App and all of its content, features, and functionality — including but not limited to text, graphics, logos, and software — are owned by StrokesIQ and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes.

Your golf data remains your property. By using the App, you grant us a limited licence to store and process your data solely for the purpose of providing the App's services to you.

7. Disclaimers

The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

Strokes Gained calculations are based on published statistical baselines. We do not guarantee the accuracy, completeness, or fitness for any specific purpose of the analytics provided. The App is not a substitute for professional golf instruction.

8. Limitation of Liability

To the fullest extent permitted by applicable law, StrokesIQ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or loss of goodwill, arising out of or in connection with your use of the App, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of or relating to these Terms or the App shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Termination

We reserve the right to suspend or terminate your account and access to the App at our sole discretion, without notice, if we believe you have violated these Terms. You may also delete your account at any time through the App's Profile screen.

Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination will remain in effect.

10. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts.

11. Changes to These Terms

We may revise these Terms at any time by updating this page. We will provide notice of material changes by updating the "Last updated" date. Your continued use of the App after any changes constitutes your acceptance of the revised Terms.
